1. Scope
These terms govern the use of Shiny Wall's software: the Shiny Wall (mobile) and Shiny Wall Tablet (gym) apps, the customer web panel and the related paid plans. They apply to anyone who creates an account or uses the apps, whether or not they own a Shiny Wall wall.
Using the apps with a Shiny Wall wall is free and requires no per-user subscription. Only the Lasso plans and the renewal of the Lite app from the second year onwards are paid services, and they are also governed by sections 5 to 7.
Hardware purchases are governed by the General Terms of Sale, and the processing of personal data by the Privacy Policy.
2. Registration and account
An account is required to use the apps. Users must provide accurate information, keep it up to date and safeguard their credentials: they are responsible for all activity carried out under their account and must notify us of any unauthorised use.
You must be at least 16 to create your own account, or the minimum age set by the law of your country of residence where that is lower (14 in Spain). Younger users may only use the service under the account and supervision of a responsible adult.
Users may delete their account at any time from the app itself or by writing to info@shinywall.com.
3. Community content
The apps allow users to create boulders and routes on a wall and to log their activity on them: when marking a boulder as sent, the user can propose a grade, rate it with stars and add a comment. All of this is published as activity on the route and becomes available to the community.
Published boulders are final: they cannot be edited or deleted. The reason is that other climbers have already climbed and saved them, and altering or withdrawing a boulder would change their activity. The rating can be updated at any time: the user may change the proposed grade and the stars, and edit or delete their comment, which then stops being displayed in the service, except for technical backups.
To the extent that this content may be protected by intellectual property rights, the user grants Shiny Wall a free, worldwide and indefinite licence to reproduce, display, adapt and distribute it within the service and in the promotion of Shiny Wall.
Activity is displayed linked to the climber's username, never to their real name or email address. If the user deletes their account, their content remains published but is no longer associated with them: it is anonymised.
Beta videos. Shiny Wall does not host the videos. Each user publishes them on their own Instagram account mentioning Shiny Wall; that mention triggers the automatic linking of the video to the corresponding boulder, and the app only displays a reference to the original post, which plays on Instagram. By mentioning us publicly, the user requests and authorises that link. If they delete the post or make it private, the video is no longer reachable from the app; they can also ask us to remove the link by writing to info@shinywall.com. The Instagram post itself is governed by that platform's terms, which are outside Shiny Wall's control.
Users warrant that they have the right to publish what they publish, that it does not infringe third-party rights, and that anyone appearing in their videos has consented to being shown.
Moderation. Shiny Wall may remove content, unlink a video or suspend accounts that breach these terms or the law, notifying the user unless removal is urgent or ordered by an authority. Anyone can report inappropriate content from within the app or by writing to info@shinywall.com; reports are reviewed as promptly as possible. Shiny Wall is under no general obligation to monitor published content.
4. Acceptable use
The following is not permitted:
- Publishing illegal, violent, sexual or discriminatory content, or content that harasses or humiliates others.
- Impersonating third parties or using another user's account.
- Publishing content that infringes intellectual property or image rights.
- Manipulating scores, rankings or grade ratings.
- Accessing or attempting to access third-party systems, accounts or data, or interfering with the operation of the service.
- Extracting data by automated means or reselling access to the service.
Breaches may result in content removal and in the suspension or cancellation of the account. In the event of a serious breach, no refund of amounts already paid will be due.
5. Paid plans
Using the apps with a Shiny Wall wall is free. The following are paid services:
- Lasso: an annual subscription that digitises an existing wall without Shiny Wall hardware, with tiers based on wall size and a Pro plan for gyms.
- Lite app renewal: the Lite pack includes 12 months of app use; from the second year onwards renewal is annual and its price is calculated according to the number of LEDs installed on the wall.
The applicable prices are those published in the shop at the time of purchase or renewal. Any price change will be communicated at least 30 days in advance and will only take effect at the next renewal: users may cancel before it applies.
6. Billing and renewal
Subscriptions renew automatically at the start of each period. The charge is made using the payment method stored with Stripe, our payment provider, and an invoice is emailed on every renewal.
If a charge cannot be completed it will be retried and the user notified; if it remains unpaid, the paid service may be suspended until the outstanding amount is settled.
7. Cancellation
Users may cancel at any time from their customer panel. Cancellation takes effect at the end of the current billing period and does not entitle the user to a pro-rata refund of unused time, except where consumer law provides otherwise.
If you contract as a consumer, you also have a right of withdrawal on the terms set out in the Returns Policy.
Cancelling a paid service does not delete the account: the free features of the apps remain available.
8. Intellectual property
The software, the apps, the web panel, the brand, the design and the content produced by Shiny Wall are the property of SHINY WALL S.L. Users receive a limited, non-exclusive, non-transferable licence to use them, valid while their account is active and, for paid services, while the subscription is up to date.
Copying, decompiling, modifying or creating derivative works of the software is not permitted beyond what the law expressly allows.
9. Availability and liability
Shiny Wall does not guarantee that the service will be available without interruption or free of errors: there may be downtime due to maintenance, updates or causes beyond our control. Planned downtime will be announced whenever possible.
Shiny Wall's liability is limited to the amounts paid by the user over the previous 12 months. This limitation does not apply to wilful misconduct or gross negligence, and does not affect rights granted to consumers on a mandatory basis.
10. Changes to the service and to these terms
Shiny Wall may modify, extend or discontinue features of the service with reasonable notice. Substantial changes to prices or to paid features will be communicated at least 30 days in advance.
These terms may be updated. Relevant changes will be communicated by email or within the app before they take effect; users who disagree may cancel their subscription or delete their account. The date of the latest version appears at the end of this page.
11. Governing law and complaints
These terms are governed by Spanish law.
Users contracting as consumers may bring claims before the courts of their place of residence. Users contracting as a business or professional submit to the Courts of Barcelona.
